Terms and Conditions of Service

Your agreement and acceptance of these Terms and Conditions or use of Sonicmedia Computer Works construes acceptance of these Terms and Conditions which supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order. Sonicmedia Computer Works reserves the right to modify these Terms and Conditions and change pricing and/or services at any time without notice.

NO WARRANTIES:With respect to the services provided, Sonicmedia Computer Works makes no warranties of any kind, whether expressed or implied, including any implied warrantee or merchantability or fitness of this service for a particular purpose. Sonicmedia Computer Works takes no responsibility for any damages suffered by Customer, including, but not limited to, loss of data from delays, non deliveries, misdeliveries, or service interruptions caused by Sonicmedia Computer Works's own negligence or Customer's errors and/or omissions.

It is a customer's responsibility to maintain their web pages. Sonicmedia Computer Works is not responsible for loss of data in regards to web pages. The owner of the web page must keep a valid copy of all web space material.

USE OF SERVICE & RESTRICTIONS: This service may only be used for lawful purposes. Materials and/or transmission in violation of any local, state or Federal regulation(s) is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret. Sonicmedia Computer Works exercises no control whatsoever over the content, quality or accuracy of the information passing through it's systems.

Customer agrees to refrain from mass postings of the same message to many inappropriate Usenet newsgroups (referred to as spamming). You agree to refrain from mass, unsolicited e-mailings, and agree to pay a $0.75 surcharge per unsolicited email. You agree to post advertisements only where appropriate, that specifically encourage or allow advertising. Customer agrees to respect the conventions of the newsgroups, lists and networks to which you are posting, including rules more restrictive than but not limited to the above.

Sonicmedia Computer Works reserves the right to refuse service to anyone, and the right to terminate any account at any time. Shell access is a privilege that can be revoked at any at Sonicmedia Computer Works's discretion. Sonicmedia Computer Works may at its discretion terminate a customer's account for excessive usage with seven days notice.

RESTRICTIONS: Customer may not use a personal or business account as a dedicated modem. Customer agrees not to run automated software to keep computer online, rather all applications must be done manually. Customer may not use personal web page to advertise a business or money-making endeavor.

Easy 10 Accounts have special restrictions, please contact billing@sonicmediacw.com for detailed information. Credit cards must remain on file and active for accessing excess usage charges, which will be automatically charged to your credit card. Charges may be processed up to 30 days after a full month of service.

Sonicmedia Computer Works reserves the right to change its pricing at any time. If the customer is on a prepaid account, the customer has the right to accept or deny the new rates. Should the customer deny the new rates, Sonicmedia Computer Works shall provide the customer a prorated refund at current rates of any time unused

CANCELLATION POLICY: (New Accounts)

  • A customer must request a cancellation for their account from the Billing Department within 7 days of account establishment
  • Activation/Setup fees are NOT REFUNDABLE.

   *Setup refers to being processed into Sonicmedia Computer Works's servers. *

  • Only access fees will be refunded.
  • Credit Card and Cash refunds will be processed within 7 to 10 days. Check and/or Money Order payments will be refunded within 21 to 30 days.

    CANCELLATION POLICY: (Regarding accounts active for more than 7      days)

  • No refunds will be processed for ANY REASON, unless they comply with the Annual Accounts Proration Policy.
  • Cancellation requests must be received 72 hours prior to account expiration date.    Cancellation requests may be sent via mail, fax, phone, or email but must be confirmed with a Cancellation Code by a Sonicmedia Computer Works Billing Department Representative or the cancellation is not considered valid.

PRORATE POLICY: ONLY Annual Personal/Individual Accounts will be eligible for a partial refund. Accounts will be recalculated at a maximum rate for entire term with a  $15.00 cancellation fee applied. Credit card and Cash refunds will be processed within 7 to 10 days. Check and Money Order payments will be refunded within 21 to 30 days.

ONLY Annual Business Accounts will be eligible for prorations in the manner as stated above, with the exception being a $35.00 cancellation fee. All prorated cancellations will be based on ALL service/products in the current billing cycle.

PAYMENT POLICIES: Customers using Auto Check Debit processing or automated Credit Card processing will be automatically renewed on your Account expiration date, unless account is cancelled 72 hours in advance of the expiration date. If cancellation request has not been confirmed prior to 72 hours, Sonicmedia Computer Works is NOT responsible for auto processing charges, and customer agrees to accept responsibility with bank or credit card Company. There is a $15.00 service charge for each returned check.

Delinquent accounts will be placed on "hold" and may not be used until the account is brought up to date. Once account is placed on "hold" Sonicmedia Computer Works cannot guarantee a users mail file will be unaffected. There will be a $5 reactivation fee to release an account on "hold". Accounts may be placed on hold one day after expiration date has passed with no payment.

NON RENEWALS: Non renewed accounts that are unpaid after 14 days will be deleted. Deleted/terminated accounts may be reinstated upon payment of any outstanding charges. There will be a $10 reactivation fee to reinstate a terminated account. Interruption of accounts does not relieve you from past due charges. After termination of account Sonicmedia Computer Works does not guarantee reservation of previous login. Sonicmedia Computer Works is not responsible for loss of data in regards to web pages.

INDEMNIFICATIONS: Sonicmedia Computer Works is not responsible for any telephone charges incurred by dialing a number that is not local to you. The Customer shall indemnify and hold Sonicmedia Computer Works, their directors, officers, and employees harmless from and against any and all damages, liabilities, losses, costs and expenses, including reasonable attorney's fees, arising out of or related to Customer use of the Internet or Customer's breach of terms and conditions of this agreement.
